PRIVACY POLICY

1. GENERAL

1.1 This is the privacy policy (“Privacy Policy”) of [MAX ASIA PTE. LTD.] (“MAX”). We are committed to safeguarding your privacy. We treat all personal data provided by you in strict confidence, and will only use your personal data in the manner set out in this Privacy Policy. This Privacy Policy applies to all personal data that you provide to us and the personal data we hold about you.

1.2 The Privacy Policy describes how we may collect, use, disclose, process and manage your personal data when you:

1.2.1 use our platform (including any information, services, contents, products, or features), as made available on our website (at https://www.maxasiasg.com/about-us.html ) and applications (mobile, web-based or otherwise) (collectively referred to as “Platform”); and/or
1.2.2 provide us with your personal data, regardless of the medium through which such personal data is provided.


1.3 In this Policy, “we”, “us” and “our” refer to MAX, and “you” and “your” refers to any person who accesses or uses the Platform.

1.4 By providing us with your personal data, accessing or using the Platform, you consent to our collection, use and disclosure (including transfer) of your personal data in accordance with this Privacy Policy. Please DO NOT provide any personal data to us if you do not accept this Privacy Policy.

1.5 Information provided by organisations to us for business purposes is not considered personal data. This Privacy Policy does not apply to business contact information.

1.6 This Privacy Policy may be available in languages other than English. To the extent of any inconsistency or conflict, the English language version of this Privacy Policy shall prevail.

2. AMENDMENTS TO THIS PRIVACY POLICY

2.1 We may amend this Privacy Policy from time to time without notice to you. The updated Privacy Policy will supersede earlier versions and will apply to personal data provided to us previously. The updated Privacy Policy will take effect when made available on the Platform. If you do not accept any amendment to the Privacy Policy, please contact our Data Protection Officer (see paragraph 11.1 below).

3. COLLECTION OF PERSONAL DATA

3.1 “Personal data” is data that can be used to identify a natural person. The personal data we may collect from you includes your name, contact details (including address), date of birth, financial information such as credit cards, transactional information based on your activities on the Platform (such as purchase history) and any other information that may be relevant in order for us to provide our products and/or services to you.

3.2 We may collect your personal data directly or indirectly, through various channels, such as when:

3.2.1 you access the Platform;
3.2.2 you enter information on the Platform;
3.2.3 you use our services or enter into transactions with us;
3.2.4 you respond to our promotions, or subscribe to our mailing lists;
3.2.5 you communicate with us by telephone, email, via our website or through other communication channels, for example, through social media platforms;
3.2.6 you register for and/or attend events organised by us;
3.2.7 your images are captured by us via CCTV cameras while you are within our premises, or when photographs or videos of you are taken when you attend events organised by us;
3.2.8 we seek information about you and receive your personal data in connection with your relationship or business dealings with us;
3.2.9 you submit an application for a position with us and/or when you provide documents or information including your resume/CVs in connection with such applications; and/or
3.2.10 when you submit your personal data to us for any other reason.


3.3 Your provision of personal data to us is voluntary. However, if you choose not to provide us with the personal data we require, it may not be possible for us to contact you or to fulfil the purposes for which we require the personal data, including processing your transactions or providing you with the products and services that you require.

3.4 We may also collect personal data from third party sources, for example:

3.4.1 from our business partners and third party service providers which provide services to us (e.g. IT, advertising, marketing and promotional services);
3.4.2 from any person who provides your personal data to us on your behalf; and/or
3.4.3 from public agencies or other public sources.


3.5 In certain circumstances, you may also provide us with personal data of persons other than yourself. If you do so, you warrant that you have informed him/her of the purposes for which we are collecting his/her personal data and that he/she has consented to your disclosure of his/her personal data to us for those purposes. You agree to indemnify and hold us harmless from and against any and all claims by such individuals relating to our collection, use and disclosure of such personal data in accordance with the terms of this Privacy Policy.

3.6 If you are using the Platform and are below 18 years of age, please obtain consent from your parent or guardian before you submit any personal data to us. If you are a parent or guardian of a minor and you have reason to believe your child or ward has provided us with their personal data without your prior consent, please contact us to request for erasure of their personal data

4. PURPOSES FOR COLLECTION, USE OR DISCLOSURE OF YOUR PERSONAL DATA

4.1 We collect, use, disclose and process your personal data for purposes connected or relevant to our business and to manage your relationship with us. Such purposes would include:

4.1.1 any purpose that may be informed to you when your personal data is collected;
4.1.2 managing your relationship with us;
4.1.3 facilitating your use of the Platform;
4.1.4 providing you with the products and/or services that you have requested for;
4.1.5 carrying out your transactions with us and/or taking steps as may be directed by you;

4.1.15 complying with any applicable laws, governmental or regulatory requirements of any relevant jurisdiction (and any applicable rules, codes of practice or guidelines), including, without limitation, meeting the requirements to make disclosure under the requirements of any applicable law or assisting in law enforcement and investigations by relevant authorities;
4.1.16 security and safety purposes; and/or
4.1.17 any other reasonable purposes related to the aforesaid.


4.2 We may also collect, use, disclose and process your personal data for other purposes, without your knowledge or consent, where this is required or permitted by law.

4.3 If you have provided us with your consent, we may use your personal data for the purposes of marketing our products and services and those of our partners and business associates (e.g. informing you of our latest activities, special offers and promotions). In order for us to market products and services which are of special interest and relevance to you, we may analyse and rely on your overall interaction with us (such as but not limited to your preferences, past transactions through the Platform and your interactions with us).

5. DISCLOSURE OR TRANSFER OF PERSONAL DATA

5.1 We may disclose or share your personal data with our related parties or business partners in connection with the above stipulated purposes. We may also disclose or share your personal data:

5.1.1 where such disclosure is required for performing obligations in the course of or in connection with our provision of goods and/or services as may be requested or directed by you;
5.1.2 with third parties who provide services to us (such as our service providers providing services such as delivery services, hosting and maintenance services, data analytics, messaging, marketing, and other professional services (including accountants, lawyers and auditors);
5.1.3 to any of the following in connection with the above stipulated purposes and/or such other purpose as may be permitted under applicable laws:

5.1.3.1 our related parties, and respective employees, agents, auditors, contractors, service providers and professional advisers;
5.1.3.2 any liquidator, a provisional liquidator, an administrator, a receiver, receiver and manager or judicial manager over us or any of our assets; and/or
5.1.3.3 any regulatory, supervisory, governmental or quasi-governmental or other authority, court of law, tribunal or person, whether in Singapore or any other jurisdiction.


5.2 The third parties set out above may be situated in Singapore or elsewhere. You fully understand and unambiguously consent that we may transfer your personal data to any location outside of Singapore for the purposes set out above. We are committed to safeguarding your personal data when it is transferred across jurisdictions. We will ensure that your personal data receives an adequate level of protection regardless of the jurisdiction to which it is transferred

6. ACCESS AND CORRECTION OF PERSONAL DATA

6.1 You must ensure that all personal data that you provide to us is true, accurate and complete. You are responsible for informing us of any changes to your personal data.

6.2 You have the right to request for access to your personal data held by us. You also have the right to request for the correction of your personal data which is inaccurate.

6.3 Any request for access or correction should be submitted to our Data Protection Officer in writing (see paragraph 11.1 for contact details). You may be required to submit certain forms or provide certain information in order for your request to be processed. Where permitted by law, we may charge you a fee to process your request

7. COOKIES

7.1 Cookies are small text files which are set by a website or application operator so that your browser or device may be recognised. We may make use of cookies on the Platform to store and track information such as the number of users and their frequency of use, profiles of users and their online preferences. Cookies do not capture information which would personally identify you, but the information collected may be used to assist us in analysing the usage of the Platform and to improve your online experience with us. You can disable the cookies by changing the setting on your browser. However, this may affect the functionality of the Platform.

8. LINKS TO OTHER WEBSITES

8.1 The Platform may contain links to other websites which are not owned or maintained by us. These links are provided only for your convenience. This Privacy Policy only applies to us and the Platform. When visiting these third party websites, you should read their privacy policies.

9. WITHDRAWAL OF CONSENT

9.1 Your personal data is provided to us on a voluntary basis. You may withdraw your consent by contacting our Data Protection Officer with your written request for withdrawal at any time (see paragraph 11.1 for contact details). If you withdraw your consent to any or all use of your personal data or do not consent to the collection of your personal data by us, we may not be able to provide or continue providing you with the products and/or services which you have requested.

10. SECURITY AND RETENTION OF PERSONAL DATA

10.1 While precautions will be taken to ensure that the personal data you provide is protected against unauthorised or unintended access, we cannot be held responsible for unauthorised or unintended access that is beyond our control.

10.2 We do not guarantee that our systems or applications are invulnerable to security breaches, nor do we make any warranty, guarantee, or representation that your use of our systems or applications is safe and protected from viruses, worms, Trojan horses, and other vulnerabilities. We also do not guarantee the security of data that you choose to send us electronically. Sending such data is entirely at your own risk.

10.3 We keep your personal data only for so long as we need the personal data to fulfil the purposes we collected it for, and to satisfy our business and/or legal purposes, including audit, accounting or reporting requirements.

10.4 In some circumstances, we may anonymise your personal data so that it can no longer be associated with you, in which case we are entitled to retain and use such data without restriction.
